That posture is what allows the firm to carry declined cases. When the Department of Justice does not intervene, the relator and counsel fund and litigate the matter themselves. Edward, with Kandis Kovalsky and Ross Wolfe, obtained a 9 million dollar settlement in exactly that situation, against private equity firm Belhealth Investment Partners, its principals, and its pharmacy portfolio companies, over off-label dispensing of a fentanyl product billed to Medicare, Medicaid and TRICARE.
His broader litigation practice is built on the same theories that recur in fraud cases: business torts including fraud and tortious interference, civil RICO, breach of fiduciary duty, and securities fraud. He has written repeatedly in The Legal Intelligencer on the False Claims Act and on civil RICO, and is a certified panel member of the American Arbitration Association for commercial litigation.
He is a member of the Taxpayers Against Fraud Education Fund, the organization devoted to advancing whistleblower interests and fighting fraud against the government. He practices in English and Korean.
